Terms of sale

Article 1 – Scope of Application

These General Terms and Conditions of Sale (hereinafter the “T&Cs”) govern all sales of ready-to-wear products concluded via the website operated by SOOTRASHOP, with consumers within the meaning of the French Consumer Code.

Any order placed on the website implies full and unconditional acceptance of these T&Cs, without restriction or reservation.

Article 3 – Products

The products offered for sale are ready-to-wear items (clothing).

Each product is accompanied by a description specifying its essential characteristics, including:

the nature of the product,
available sizes,
materials used.

Photographs are provided for illustrative purposes only and are not contractually binding. Slight variations in color or appearance may occur depending on screen displays.

Article 4 – Sizes and Fitting

The sizes offered correspond to the standards indicated on the website.
It is the customer’s responsibility to carefully consult the size guides before placing any order.

Items may only be tried on within the framework of the right of withdrawal, provided they are returned:

unworn (except for fitting),
unwashed,
undamaged,
with original tags intact,
in their original packaging.

Article 5 – Prices

Prices are indicated in euros (€), including all taxes (VAT included), excluding shipping costs.

SOOTRASHOP reserves the right to modify its prices at any time. The applicable price is the one in effect at the time the order is confirmed.

Shipping costs are indicated before final validation of the order.

Article 6 – Orders

The customer places orders directly on the website.

The order is considered final after:

validation of the shopping cart,
express acceptance of these T&Cs,
full payment of the price.

A confirmation email is sent to the customer after the order is validated.

SOOTRASHOP reserves the right to refuse or cancel any order in the event of a prior dispute with the customer or non-payment.

Article 7 – Payment

Payment is due immediately upon ordering.

Accepted payment methods are those offered on the website via the secure Shopify platform.

Banking details are never stored by SOOTRASHOP.

Article 8 – Delivery

Products are delivered to the address provided by the customer at the time of ordering.

Orders are delivered within a maximum period of 30 days from order confirmation, in accordance with Article L216-1 of the French Consumer Code.

In the event of late delivery, the customer may terminate the contract under the conditions set out in Articles L216-2 et seq. of the French Consumer Code.

Article 9 – Transfer of Risk

In accordance with Article L216-4 of the French Consumer Code, the risk of loss or damage to the products is transferred to the customer when they take physical possession of the goods.

Article 10 – Right of Withdrawal

In accordance with Articles L221-18 et seq. of the French Consumer Code, the customer has a period of 14 days from receipt of the products to exercise their right of withdrawal, without having to provide any reason.

To exercise this right, the customer must notify their decision to withdraw via the website’s contact form or by any clear and unambiguous statement.

Returned items must comply with the conditions specified in Article 4.

Return shipping costs are borne by the customer.

Article 11 – Refunds

In the event of a valid withdrawal, SOOTRASHOP will issue a refund within a maximum period of 14 days from receipt of the returned products.

The refund will be made using the same payment method as that used for the order.

Article 12 – Exceptions to the Right of Withdrawal

The right of withdrawal does not apply to:

personalized or custom-made items,
items unsealed by the customer which cannot be returned for hygiene reasons, in accordance with Article L221-28 of the French Consumer Code.

Article 13 – Legal Guarantees

The products sold benefit from:

the legal guarantee of conformity provided for in Articles L217-3 et seq. of the French Consumer Code,
the warranty against hidden defects provided for in Articles 1641 et seq. of the French Civil Code.

The consumer has a period of two years from delivery of the goods to act under the legal guarantee of conformity.

Article 14 – Liability

SOOTRASHOP shall not be held liable for damages resulting from improper use of the products.

SOOTRASHOP’s liability shall not exceed the mandatory legal provisions applicable.

Article 15 – Personal Data

The personal data collected is necessary for order processing and customer relationship management.

In accordance with the GDPR, the customer has rights of access, rectification, deletion, and objection, which may be exercised via the website’s contact form.

Article 16 – Consumer Mediation

In accordance with Articles L612-1 et seq. of the French Consumer Code, the customer has the right to have recourse, free of charge, to a consumer mediator for the amicable resolution of a dispute.

The mediator’s contact details will be provided to the customer upon request.

Article 17 – Intellectual Property

All elements of the website (texts, images, logos, trademarks) are protected by intellectual property law and remain the exclusive property of SOOTRASHOP.

Any unauthorized reproduction or use is prohibited.

Article 18 – Applicable Law and Disputes

These T&Cs are governed by French law.

In the event of a dispute, an amicable solution will be sought prior to any legal action. Failing this, the French courts shall have jurisdiction.
